Turkmenistan SSR declared the sovereignty of Turkmenistan State through the Turkmenistan Council on the date of 22nd August 1990 and a general election was held on the basis of public voting carried out on the date of 27th October 1990. As a result of this general election, Saparmurat Niyazov who obtained 98,3% of the total votes became the first State President that came to power through elections as the head of the Turkmenistan SSR. Turkmenistan SSR declared its independence as a result of the referendum that was carried out on the date of 27th October 1991.

The new Constitution of the independent Turkmenistan was ratified with the unanimous vote of Turkmenistan Council on the date of 18th May 1992. The presidential elections were repeated on the date of 21st June 1992 and Saparmurat Niyazov obtained 99,5% of the voters and he was re-elected as the State President of Turkmenistan. The new Constitution stipulates the system of presidency and the State President reserves the legislative power providing the approval of the Council. The Deputies of the President, the Ministers, Judges (Municipality Mayors + Governors), and the Head of the Supreme Court are assigned by the State President. The State President who also chairs the Cabinet of Ministers reserves the right to dissolve the Council in case of necessities.
